A sociologist who has to confront him/herself with social change cannot avoid running into subjectivity, which is seen as a clear indicator of the most recent tendencies that are going through contemporary society. The demand for subjectivity, generically considered as self-consciousness and the need for self-fulfilment, is undoubtedly a distinguishing feature of our age. The central role this concept has gained within recent sociological literature, however, coincides with the rise of a postmodern sociology, which tends to put forward a precise (...) image of subjectivity that I would call ?minimalist.? Through its call for subjectivity, postmodern sociology intends to celebrate indeed a radical freeing from the ethical, social, and relational constraints that would have oppressed human beings during modernity, which was characterized by a high degree of sociocentrism. Although I share all the contentions that aim at underlining the positive achievements of subjectivity over the constrictions and the de-personalizing forces that distressed the so-called homo sociologicus, I think we need nonetheless to distance ourselves from this new reductionism, which levels out subjectivity to its postmodern conception, and to underline instead the existence of a dual aspect in contemporary subjectivity. As a matter of fact, along with its minimalist and disengaged aspect, conceptualized in the homo psychologicus, another possible expression, called ?significant subjectivity? is emerging, which is a typical feature of the kind of human I propose to define civicus, a human who distinguishes him/herself because of the ability to become the bearer of an authentic form of responsible freedom. Consequently, we can identify two different aspects, at least, in contemporary subjectivity, notably a minimalist and a significant aspect. (shrink)

On Borders asks when are borders legitimate, and it offers a new theory to answer the question. The book challenges critical and normative theories that criticize or justify borders solely in terms of identity, and instead frames borders and border legitimacy from the perspective of place and presence. Instead of thinking of borders as the exclusionary limit of identity groups, the book develops a theory of territorial jurisdictions grounded on place-specific relations, giving central roles to urban settings and the environment. Democracy is usually conceived as based on self-rule or rule by the people, and it is this which is taken to ground the legitimacy of the democratic form of government. But who constitutes the people? Democratic political theory has a potentially fatal weakness at its core unless it can answer this question satisfactorily. In _The Time of Popular Sovereignty_, Paulina Ochoa Espejo examines the problems the concept of the people raises for liberal democratic theory, constitutional theory, and critical theory. (...) She argues that to solve these problems, the people cannot be conceived as simply a collection of individuals. Rather, the people should be seen as a series of events, an ongoing process unfolding in time. She then offers a new theory of democratic peoplehood, laying the foundations for a new theory of democratic legitimacy. (shrink)

One such myth concerns what happened with poetry in general, that is to say, imaginative literature or literary fiction, in the transition from the Middle Ages to the Renaissance and beyond. Its basic outline was developed during the nineteenth century. J. E. Spingarn, for example, echoes such a myth in (...) his History of Literary Criticism in the Renaissance, first published in 1899, which has gone through many editions and reprintings since then. In it we read the following: The first problem of Renaissance criticism was the justification of imaginative literature. The existence and continuity of the aesthetic consciousness, and perhaps, in a less degree, of the critical faculty, throughout the Middle Ages, can hardly be denied; yet distrust of literature was keenest among the very class of men in whom the critical faculty might be presupposed, and it was as the handmaid of philosophy, and most of all as the vassal of theology, that poetry was chiefly valued.... The Renaissance was thus confronted with the necessity ofjustifying its appreciation of the vast body of literature which the Revival of Learning had recovered for the modern world. (3) Speaking of Savonarola's De Divisione ac Utilititate Omnium Scientiarum, written about 1492, he concludes as follows: In fine, as a reformer, he represents for us the religious reaction against the paganization of culture by the humanists. But the forces against him were too strong. Even the Christianization of culture effected during the next century by the Council of Trent was hardly more than temporary. Humanism, which represents 74Cesáreo Bandera the revival of ancient pagan culture, and rationalism, which represents the growth of the modem spirit in science and art, were currents too powerful to be impeded by any reformer, however great. (14) This general picture of the historical standing and the fate of literary fiction as we move from the Middle Ages into the modern era, is still very much with us, even though it is ill at ease with, or flatly contradicted by, undeniable historical facts. For example, the incredible notion of a "paganization of culture by the humanists" would have horrified somebody as profoundly Christian as Petrarch and, later on, Erasmus, who criticized the scholastics "in the name of a purer and simpler mode of piety and religious devotion" (Mazzeo 17). Or the mistaken idea that modern rationalism was much more hospitable to poetry than the old scholastic one. For from the seventeenth century on, as J. F. West has pointed out, the whole tide of [scientific] opinion was running strongly against poetry, metaphor, and poetic prose. The philosophers generally saw them as an obstacle to truth. Hobbes regarded metaphor as one of the hindrances to straight thinking. Rousseau thought that the philosophy of Descartes had 'cut the throat of poetry'; and John Locke, late in the century, openly regarded poetry as made up of 'pleasant pictures and agreeable visions in the fancy,' but basically misleading. (114) It is indeed true that in medieval scholasticism poetry occupies the lowest rank in the hierarchical structure of the arts and sciences. But it does have a place there. It would have never occurred to Thomas Aquinas, for example, to expel it from that position as something dangerous, something to be avoided. In fact, as he tells us at the beginning of the Summa Theologica, theology itself, the highest of the sciences, does not consider it below its dignity to make use of metaphor and other poetic devices propter utilitatem ac necessitatem. And yet it is precisely that kind of violent expulsion ofpoetic fiction that will be attempted during the Renaissance. In the words of Russell Fraser, "it is in the Renaissance, and not the Middle Ages that the artist is driven from the commonwealth" (39). It was then that the "war against poetry" intensified to fever pitch. It is, therefore, an error to imagine that those in the sixteenth and seventeenth centuries who bitterly attacked poetic fiction in general and the theater in particular as a very dangerous threat to religion and morality, were fanatic hold-overs from a medieval past... The thesis of political theology holds that all justificatory theories of the state rely on metaphysical assumptions, rather than just empirical facts and accepted political conventions. For this reason, the thesis challenges liberal theories that justify the state on the basis of individual autonomy and popular will. The thesis is controversial because many theorists believe that metaphysical assumptions introduce decisionism – the view that a state depends on the unrestrained personal decision of a ruler – to the theory of the (...) state. But, does political theology entail decisionism? This article argues that decisionism does not follow necessarily from political theology because an omnipotent deciding sovereign is only one of many possible metaphysical assumptions in theology. It illustrates this claim with examples from the philosophy of Nicholas Cusanus and process philosophy. This conclusion challenges two different entrenched views: first, that the modern state is a continuation of theistic beliefs; and second, that metaphysical discussions have no place in contemporary normative political theory. The negative impacts of agriculture on the environment and the inequity that limits access to healthy food for the entire population impede sustainable development. This article reflects contributions to food security and alternatives for transitioning to sustainable food systems. It is concluded that food, as a human right, is a complex and transdisciplinary issue, which must be integrated as a transversal axis in the economic, social, environmental, governance, and cultural dimensions to contribute to sustainable development and therefore the convenience of (...) making the transition from the concept of food security to that of food sustainability. This article analyzes the epistemological legitimation of mathematics in natural philosophy in the seventeenth century. In the Renaissance it was claimed that mathematics does not meet the Aristotelian criteria of scientificity, and that it did not explain the efficient and final causes. So, its critics, inspired by the Aristotelian tradition, rejected the first attempts to mathematize natural philosophy. The epistemological conditions involved in the debate are examined on the scientific nature of mathematics and its relevance to natural philosophy. A historiographical (...) tour of the mathematization of nature is made to provide new weighing elements with respect to a historically and philosophically more conceptual characterization of the emergence of modern science. El artículo ofrece un panorama general de la argumentación en el ámbito jurídico a efectos de proporcionar lineamientos útiles a los operadores jurídicos principalmente como una aproximación metodológica tratando de incluir los aspectos indispensables para comprender la relación entre lenguaje y derecho. El tema se aborda desde diversas disciplinas, como son la filosofía del derecho, la lógica y la semiótica.

En el presente ensayo se realiza una reflexión general sobre el concepto de derecho, el método analítico y el proceso de conocimiento para después hacer algunos comentarios sobre el análisis hecho por Jorge Rodríguez del concepto de derecho en su Teoría Analítica del Derecho, así como un par de observaciones específicas sobre la fórmula Radbruch de la injusticia extrema y el no positivismo incluyente.

Mediante un lenguaje paradojal, la obra de Miguel de Unamuno plantea de modo recurrente la cuestión de Dios, especialmente en el libro Del sentimiento trágico de la vida. Lo plantea bajo dos perspectivas: la del Dios pensado y la del Dios sentido. En ambos casos se trata de un Dios personal cuyo encuentro tiene lugar por vía de la intuición vivencial y el recogimiento. Se reconocen allí coincidencias con San Juan de la Cruz, y en general, con la mística al (...) privilegiar el sentimiento frente al entendimiento, la vivencia frente a la racionalidad. (shrink)

El objetivo de este artículo es analizar en “Nocturno de San Ildefonso” (1974) las diversas “escenografías autoriales”, como denomina José-Luis Diaz al dispositivo en el que se inscribe el “escritor imaginario” para asumir una postura o identidad literaria y estructurar su desempeño público. En este poema de evocación autobiográfica el poeta ya sexagenario rememora y reconstruye fragmentariamente su pasado juvenil, sus primeras inquietudes estéticas e ideológicas, así como su iniciación poética. De clara raigambre romántica, las escenografías autoriales presentes en Nocturno (...) de San Ildefonso constituyen el marco para su autofiguración madura como poeta vidente y su autorrepresentación juvenil como ideólogo y polemista en ciernes, al tiempo que define, mediante poderosas imágenes, su concepción poética. El artículo tiene como punto de partida los cuatro discursos lacanianos: el discurso del amo, de la histérica, de la universidad y del analista. A través de los tres registros lacanianos, simbólico, imaginario y real, se alcanza el punto de llegada: tres metadiscursos jurídicos en los que se establecen tres diferentes formas de asociación (Derecho-ciencia-registro simbólico, Derecho-técnica- registro imaginario y Derecho-arte-registro real). El cuarto nudo/registro (síntoma) y la cuarta dimensión jurídica (historia) se desenvuelven en un contexto iuspsicoanalítico —caracterizado por la (...) falta— que tiene en cuenta «la impotencia de la verdad» y «el poder de los imposibles». Esta reflexión evidencia cómo desde los años sesenta Amílcar Osorio produce una práctica artística en procura de la desinstitucionalización de la literatura y del arte, al situar sus objetivos estéticos no solo en las letras como posibilidad narrativa y poética, sino en la utilización de lo visual, el espacio y la vida misma como recurso artístico. Con esto el autor consigue difuminar las fronteras entre literatura, artes visuales y de acción, y logra producir lo que se puede considerar hoy una (...) práctica intermedial, al tomar estrategias propias del arte conceptual que le permiten conectar la vida cotidiana, la literatura, las ideas como expresión artística, la imagen y la performance. Who is made unfree by systematic injustices, like poverty, patriarchy, or race? Many think the answer is, "The victims." Who has duties to challenge these injustices? Many say, "The privileged." To both, this book offers a different answer: "Everyone." Everyone is made unfree by such injustices: victims, bystanders, and perpetrators alike. For such injustices try to suppress everyone's resistance to their workings, and that suppression counts as arbitrary power. Moreover, everyone has a duty to themselves to be free. En los tiempos que corren parece ser que se ha ido gestando un nuevo tipo de sociedad en la que el consumismo es el núcleo moral de la vida. Todo hoy está sometido a la lógica de un mercado que tiene como nota preponderante la seducción; de ahí que lo lúdico y lo estético pretendan operar hoy en día como ejes integradores de la cultura. Embellecerse exteriormente y divertirse han devenido deberes, tanto que la gente suele sentirse avergonzada de trabajar (...) mucho y no gozar más, de no disponer de más tiempo libre para disfrutar más, con lo cual resulta evidente que seguimos viviendo bajo el signo de la desmesura: en la Modernidad vivimos para trabajar, hoy trabajamos para consumir. Vocación es una categoría ética, que alude a la perspectiva en que ponemos nuestra vida y a las preferencias que la van orientando en la praxis cotidiana. En sentido ético, la vocación tiene cuatro notas definitorias: Las elecciones cotidianas, la prudencia, la realización efectiva del proyecto fundamental y la entrega personal y comunitaria a un quehacer, y a éstas hay que adicionarles la vertiente religiosa o trascendente. La tarea moral, consiste en llegar a ser lo que se puede ser, con (...) lo que se es, de donde resulta que el verdadero destino es nuestro ser mismo: «Llega a ser el que eres». La vocación más que un llamado es «un êthos de fidelidad a sí mismo», un programa de vida, un afán de ser responsable y «tomarse en serio la vida», buscando que sea auténtica y plena. (shrink)

ObjectiveTo provide insights on emergent ethical tensions experienced by mental health practitioners during system re-organisation, which is sufficiently grounded in empirical data at the local level to inform policy on recovery at institutional and provincial levels.MethodEthnographic methods using narrative and critical phenomenological resources over 24 months.FindingsEveryday ethical tensions emerged at the confluence of different experiences of time, for example, how a context of increasing pressure to decrease patients’ length of stay at the hospital challenged efforts to listen to and advocate (...) for what mattered to patients and maintain the integrity of interventions. In this context, practitioners drew on clinical language and that of personal recovery to strategically ‘push back’, ‘play with’ or ‘take back’ time.DiscussionExamining everyday practices through ethnographic methods can illuminate the everyday ethical tensions that arise when mental health professionals and psychiatrists grapple with, often competing, goods. Critical phenomenological resources can help expand the structural considerations in empirical ethics, excavate underground practices and raise questions about the conceptual categories undergirding normative ethics. Experiencing-with practitioners in clinical contexts as they encounter and creatively resolve ethical tensions also propose a normative ethics of possibility, to help bridge the gap between empirical and normative ethics.ConclusionFocus on the relationship between policy, temporal practices and ethics suggests a reconfiguration of time and re-imagination of ethics in institutional settings in ways that can ultimately benefit patients and professionals alike.
